They kinda messed up with that one, lore wise that is madara in his edo state, same move set, same mystery same design. Apperently it susposed to be madara after he redid the edo tensei jutsu which (Keeps him in edo tensei) but yeah maybe balancing reason?

Even if he did release jutsu he is still Edo Tensei he is not alive person so he should be in category of Edo Tensei.

Well, Edo Tensei isn't phisical form, but just name for specific jutsu of reanimation. Reanimated Madara keapt alive becouse of Hashirama cell and not becouse someone casting Edo Tensei jutsu on him to keaping him alive trough chakra.

For exemple we can take Gaara, he is also reanimated by Chiyo, but he is never anything close to edo tensei

Well, Just To Be Fair Here..The Jutsu That Chiyo Had Used Onto Gaara's Body To Bring Him Back From The Dead (That Is) Was Actually Called "Life Transfer Jutsu" In Which Chiyo Had Exchanged Her Life For That Of Gaara's That Is (As Such) Which Really Doesn't Even Deal With Supplying Various Amounts Of Chakra From One Person To Another That Is To Still Keep That Person Alive Now Does Is It..?
