It was always like this, it's not a bug. Just not written in skills description.
Btw, if you think it's a bug, why do you post in "General" section and not in "Bug"?

Hi! As s1volu said, it is not a bug as the ninja does have a mystery with the ability to hit the opponent regardless if they can dodge.
