There is no warning as well, it will take a simple parent with wise parent fueled with hatred to sue them and win the court, because...there is no warning when starting game, kid can get epilepsy instantly and done...
I had this question myself some time ago, the flashing screen when having action is totally unnecessary and isn't an option in this game. Why? There are no benefits to this whatsoever, and it doesn't look cool, it's just being annoying af. One day it can awaken epilepsy in someone who never experienced it. Many companies are doing it, but these below radar free to play companies are like black market, they don't care, it's just business to them.
I think we all are waiting until some incident will arise that had no warning messages prior to it, we always are waiting for something bad to happen just to start the change, and not before.
There is, however, an actual game play benefit to disabling animation, as it is one of the source of action delay (mind you not lag but delay), consumes more system resource on slower machines (which will cause lag) as well as block you from targeting for your next mystery.
So any smart and learned player will end up disabling it if it's optional and kind of defeat the purpose.
Frankly, the health issue is overstated. The chance of something happening is in directly correlation with the frequency of flash and have a correlation with certain colors. This game isn't bad enough, the pokemon case is extremely rare because you can hardly design a video sequence to be worse. That said, a warning would have been nice but it's really not as frequent a problem as people think.
