About the rigged events limiting ninja to being available only 1 time a day not being *:
* must be proved by showing that the defendant's actions involved five separate elements: (1) a false statement of a material fact,(2) knowledge on the part of the defendant that the statement is untrue, (3) intent on the part of the defendant to deceive the alleged victim, (4) justifiable reliance by the alleged victim on the statement, and (5) injury to the alleged victim as a result.
Lets see here... (1) I currently don't have the evidence I need because there is no real event that fits the bill this week, but the typical information is something like "spin for a chance at these awesome rewards."
(2) Well, a person in close contact with the company came out with full conversations in which one section clearly showed an Oasis rep telling him how many Naruto Kyuubi frags he would get from a specific number of spins, and then when he got nothing they gave him compensation personally, but never announced the issue nor compensated anyone who didn't know to complain. Sure sounds like it had been brought to their attention that they were telling someone something that wasn't true. (3) You can view part of what I said in 2 as evidence to this. If the company was not trying to deceive people how hard would it have been to say "we're sorry it has been brought to our attention that this event is not working the way we intended. We will fix the rates now." Moreover, there is zero communication which, now that there are allegations of all of these things, makes the entire community wonder what else is being hidden from us and it seems like a pretty convincing case for "they're deceiving us by not telling us anything was ever wrong." (4) this one is pretty simple: the game almost entirely requires people who enjoy the game on a * level to spend on these events to keep up in the race. They are depending on the rates to be fair so that they can maintain their interest without bankrupting themselves or otherwise. (5) I'm fairly certain that spending money under the false assumption that there was ever a chance you could get what you were spending for fills this one nicely. Injury is: " leaves her or him in a worse position than she or he was in before the *."
Now, you make your own *conjectures*, (because what this man was doing was making conjectures based on information not providing an opinion, there is a difference.) but I'm pretty sure someone who digs a deeper than I just did has a case for * from this company. I will say that this is based off of the American law's definition of how to define *, but I can't imagine Chinese law differing too much on it.
I do believe that there are better ways to get back at Oasis than suing and refunding, because at the end of the day the game itself with no politics is awesome. I have played since the beginning of Server 1 and recently (3 months ago) moved to server 297. I have spent less than $50 and have over 40k power, chojuro, danzo, darui, kazekage gaara, and mifune without buying any seal scrolls or otherwise. I only have this because I knew the game prior, but still. It is possible to play this game as free to play or at the minimum by only spending on guaranteed things.
and one last note on the statements about Aristeus.. if you want to only use the section of the conversation that Oasis provided when making their statement I challenge you to go see the rest of the conversation where he mentioned all of the changes he wanted to see made to the game to benefit the entire community and where he said that he made that * "attempt to extort them" because he knew they wouldn't listen to anything he asked for and he never wants to come back to a game that didn't make the changes that he, and many others in the stream while it was happening, all thought to be very fair ideas for change. The man had to lie to people every day to represent this company, and he finally spoke out about it.. If you want to chastise him over taking his demands over the top like that, then so be it. Thats on you.
