That's intended, just because you are red don't mean you should be bothered during wanted missions/team instance. Plus it's really easy to ask someone from different group to clear your name or stay in base which is the best hiding place. Getting rid of this won't stop people from hiding, just will make it annoying that people can waste your time if they attack you when you are doing stuff in team.
